• Manhattan is an island, so land is scarce.
• Manhattan has very strict zoning laws to prevent uncontrolled growth. In most areas only existing buildings can be replaced with new ones. For investment purposes and renting out your apartment, it’s best to have a condominium. Avoid co-ops, “condops” and buildings that do not own the land on which they are built (“landlease” buildings).

Why are condos the preferred form of ownership?

With a condo you own a specific apartment outright and have full power over it, including use and disposition, a right also known as “fee simple” or “freehold.” You also own a percentage of the common areas and of the land on which the building is built. This is very important because a large part of the appreciation actually comes from the land (which is scarce).

When you buy a co-op you buy shares of the company that owns the building, which in turn gives you a proprietary lease for a specific apartment. You never become owner of actual real estate, or what is called “real property.” What you buy instead is shares in a corporation for which you receive a certificate like a stock certificate.

How come co-ops generally do not work well for investment purposes?

There are significant restrictions of ownership attached to co-ops.

For starters, you cannot rent out your co-op apartment unless the building’s board grants you permission. Also, if you want to resell your apartment you may only do so if you find a buyer who is acceptable to the board of directors of the co-op building.

If the board declines your buyer, you have to find a new one and you are not entitled to any compensation for your extra work in doing so. The reason or reasons for the rejection do not have to be disclosed and rarely are. It happens quite often that several buyers are declined, which makes selling a co-op a frustrating and lengthy process. A condominium, on the other hand, can be resold at any time and without any restriction.

Are co-ops cheaper than condos?

Many co-ops appear to be cheaper than condos, but in reality most are not: The company from which you buy shares typically has acquired the building with a mortgage. You repay a percentage of this mortgage with your monthly charges because part of the debt is attached to your shares. When the mortgage on the building is increased or refinanced, your monthly maintenance can increase further. In financial jargon you are acquiring the shares of a heavily leveraged company.

What’s a land lease?

Luckily, most new buildings in Manhattan are proper condominiums and therefore an excellent investment.

A few buildings in Manhattan, most notably those in the area of Battery Park City, do not own the land on which they are built. This results in lower acquisition costs but significantly higher costs for upkeep, as the land lease is an additional expense for the building. Such apartments are much harder to resell and tend to appreciate less. While they may be great places to live, they would not be my first choice as an investment.

It is very important to have a clear answer to this question before you even start the search for your apartment. Each new building has specific characteristics and might work better or worse for you depending on the desired outcome. If you are looking maximum value, always buy into a quality building. This sounds neither new nor original but it is one of the fundamental truths of real estate investment and can easily be overlooked or missed by the novice or uninformed investor. Here are some key elements that define quality:

LOCATION

Location is the most important factor for appreciation. A prime location will always be sought after.

CLOSE TO TRANSPORTATION

If you live in New York, it is not necessary to have your own car due to the excellent subway and bus system, in addition to the 12,000+ yellow taxicabs. The density of infrastructure makes living here easy and agreeable, which is another reason why New York is such a unique real estate market. It simply does not make sense to buy property that is out of the way, not yet touched by public transportation or hard to access in other ways.

Rule of thumb: The closer the next subway station is, the better the appreciation of a building.

AMENITIES OF THE BUILDING

The better the amenities of a building, the more desirable it might be. Look for common area space such as lounges, club rooms, roof decks and any other areas that “add to the space” of your apartment. For example, if your building has a lounge, you can receive visitors there, so you need less space in your apartment. If your building has lots of outdoor space as a common area, a private balcony might not be as important.

24-HOUR DOORMAN IS A MUST

In New York, an upscale residential building is expected to have a 24-hour doorman. Not only does the doorman provide valuable services, such as receiving visitors, signing for deliveries and helping you in case of emergencies, but above all the doorman is an important security feature.

The only exception to this rule is a smaller building with low carrying charges, where even the presence of a part-time doorman adds to the value. Buyers will be attracted by the benefit of a more private residence.

LOW CARRYING CHARGES

There is a distinctive relationship between the carrying costs of an apartment and its appreciation. The lower the monthly costs, the better the appreciation. There is a simple reason for this: the concept of total cost of ownership. Those total costs comprise the mortgage, the common charges for the upkeep of the building and the monthly taxes. A buyer or his lender will make sure that the total of these expenses does not exceed a certain percentage of the household income, for example 26 percent.

With this information in hand, buyers tend to look for the best apartment they can afford. Since the amount of the mortgage payment is determined by the purchase price, the purchase price can be higher if common charges and taxes are lower. This is why buildings with low common charges sometimes see a stellar rise in price on the resale market.

ADDITIONAL PERKS

Very few buildings in Manhattan allow short-term rentals. Typically, you have to rent out your apartment for at least a year. Of course, you might agree to a tenant’s request to leave earlier. But if you are planning to rent your apartment out frequently for short- term periods, you might run into a conflict with your building.

Nevertheless, short-term rentals are in high demand in Manhattan and tenants are willing to pay a premium when renting short-term. For example, people that are on a short-term work assignment in New York, such as consultants, students, interns who are here over the summer only or people in the entertainment business are reluctant to commit to long-term leases. A Broadway show might close earlier than expected, so people working in the show might find it hard to justify renting something for a full year.

There are a few buildings that explicitly allow short-term rentals, and if you can get a condominium apartment in one of those, you will see an even higher return on your investment. However, even in a building that requires one-year leases it is perfectly permissible and legally possible to rent your apartment out for a year, then use it for yourself or a family member for a couple of weeks and then rent it out again. As an owner of a condominium apartment you are not subject to restrictions regarding your use of the apartment—you can stay there for as long or as short as you like.

If you require additional flexibility, a one-year lease contract might have an “escape clause” that allows your tenant to cancel after six months.

If you work with an experienced broker, he or she will be able to find you a building that has many of the qualities mentioned. Also, a good broker can give you additional valuable information, for example, how much similar apartments are selling or renting for in the area or how prices recently developed in a specific part of the city.

TYPE OF BUILDING AND LOCATION

If you are looking for long-term ownership, you want to buy into a luxury building with good amenities and in an excellent location. Such properties are more expensive in today’s market, but might hold their value better in the long term. They also tend to appreciate better. Even in more difficult market periods, the luxury segment is hurt less, because buyers in that segment typically buy all cash or at least do not have to consider distress sales.

Choosing a neighborhood is a lifestyle choice and unique to each individual. Although Manhattan is an island, its different neighborhoods and enclaves are fine-tuned to specific lifestyles. That results in a unique and intimate relationship between small districts of the city and their inhabitants. No other city in the world provides such a diverse experience of life just two or three subway stops apart.
